Terms and Conditions – Jacques Mostert T/A makeitwood

Welcome to Jacques Mostert T/A makeitwood. By placing an order through my online store, you agree to these Terms and Conditions. Please read them carefully before making a purchase.

1. Introduction

By placing an order, customers acknowledge and agree to these Terms and Conditions.

2. Eligibility to purchase

  • Sales and delivery are limited to South Africa.
  • There are no age restrictions for purchasing products from the store.

3. Products and Orders

Handcrafted Nature of Products
All items sold by Jacques Mostert T/A makeitwood are handcrafted from natural wood. Variations in grain, knots, texture, and color are inherent to the material and part of each piece’s unique character. These variations are not considered defects.

Ready-Made Products
Ready-made pieces are offered as described on the online store. While every effort is made to provide accurate product descriptions and photographs, slight differences may occur due to lighting, screen settings, or natural material variation.

Custom and Bespoke Orders
Customers may request custom or commissioned items. Custom orders will be confirmed in writing (via email or other communication) and may require an upfront deposit before production begins. Once confirmed, custom orders cannot be cancelled or refunded, except in cases of manufacturing defect.

Order Acceptance
An order is considered accepted only once full payment (or deposit, for custom work) has been received and confirmed. Jacques Mostert T/A makeitwood reserves the right to decline or cancel an order for any reason, including but not limited to stock availability, errors in product information, or suspected fraudulent activity.

4. Pricing and Payment

Pricing
All prices are in South African Rand (ZAR). As the business is not VAT registered, no VAT is charged or added.

Payment Methods
Payments can be made securely using the methods supported by Yoco, including major debit/credit cards, EFT and Apple Pay. No order will be processed until payment has been successfully received and confirmed.

Custom Orders and Deposits
Custom or commissioned items will require a deposit before production begins. The deposit amount will be agreed upon in writing with the customer. Deposits are non-refundable once work has commenced. The remaining balance must be paid in full before delivery or collection.

Order Completion
For ready-made items, full payment is required upfront. Orders will not be shipped or made available for collection until full payment has cleared.

5. Shipping and Delivery

Courier Services
All orders are shipped nationwide within South Africa using The Courier Guy.

Dispatch Times
Ready-made items will be dispatched within 48 hours of receiving full payment. Custom or commissioned items will be dispatched once production is completed and final payment has been received.

Shipping Costs
Shipping costs are calculated at checkout based on the customer’s delivery address, and product size and weight. The shipping cost is payable by the customer.

Delivery Times
Delivery times vary depending on the buyer’s location, order time, and the courier’s schedule. While every effort is made to ensure prompt delivery, exact dates cannot be guaranteed.

Risk and Responsibility
Risk in the goods passes to the customer once the order has been handed over to the courier. Jacques Mostert T/A makeitwood is not responsible for loss, delay, or damage to goods in transit. Customers are encouraged to track their parcels using the courier’s system.

6. Cancellation, Returns, Refunds and Exchanges

Cancellations
No cancellation will be allowed once an order is shipped. To cancel your order, please contact makeitwood via the contact form. Cancellations are subject to a 10% admininstration fee.

No Returns or Exchanges
Due to the handcrafted and bespoke nature of the products, no returns, exchanges, or refunds are accepted on any items, whether ready-made or custom-made.

Defects and Issues
If an item is delivered with a clear manufacturing defect, customers must notify Jacques Mostert T/A makeitwood in writing within 48 hours of receiving the order. Each case will be reviewed individually.

Natural Variations
Variations in wood grain, color, or texture are not considered defects.

7. Warranty and Liability

Sold As-Is
All products are sold as-is, with clear photographs and descriptions provided on the product detail pages. No warranties, express or implied, are provided regarding durability, performance, or suitability.

Use of Products
Customers are responsible for the proper use, handling, and maintenance of all products. Natural changes in wood due to environmental factors (humidity, sunlight, temperature) are not considered defects.

Limitation of Liability
Jacques Mostert T/A makeitwood will not be held liable for any damage, injury, or loss arising from the use or misuse of its products.

8. Intellectual Property

Ownership
All designs, photographs, logos, and branding are the intellectual property of Jacques Mostert T/A makeitwood.

Protection
No part of the website, product images, or designs may be copied, reproduced, or used without prior written consent.

9. Privacy Policy

Personal information collected during ordering is handled according to the separate Privacy Policy, available on the Privacy Policy page. By placing an order, you agree to its terms.

10. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes will be submitted to the applicable courts in Cape Town, South Africa.

11. Amendments

Jacques Mostert T/A makeitwood reserves the right to update or amend these Terms and Conditions at any time without prior notice.

Changes take effect immediately upon posting to the website. Customers are encouraged to review the Terms periodically.
